1. Acceptance of Terms

By downloading, installing, or playing Don't Touch Red (com.donttouchred.game), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the app.

2. Age Requirements

Don't Touch Red is intended for users aged 18 and older. By using this app, you represent that you are at least 18 years of age. If you are under 18, you are not permitted to use this app and must uninstall it immediately. We do not knowingly permit users under 18 to use the app or collect personal information from them.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Don't Touch Red for personal, non-commercial entertainment purposes on devices you own or control. You may not: copy, modify, distribute, sell, sublicense, or reverse engineer any part of the game or its content.

4. User Conduct

You agree not to:

• Use cheats, hacks, bots, or unauthorized third-party software to manipulate game data, scores, or in-game currency
• Submit leaderboard display names that contain hate speech, slurs, sexual content, threats, impersonation of real individuals or public figures, or personal information such as real names, email addresses, or phone numbers
• Attempt to disrupt, overload, or harm the game servers or infrastructure
• Use the game for any commercial purpose without our written permission
• Attempt to gain unauthorized access to other users' accounts or game data

We reserve the right to remove leaderboard entries, reset virtual currency balances, or suspend access for users who violate these terms, without notice or refund. These enforcement rights apply only to conduct violations — we will not penalize you for exercising any rights under applicable privacy law, including opting out of targeted advertising or requesting deletion of your data.

Leaderboard display names and scores are publicly visible to all players of the game worldwide. By submitting a display name, you consent to its public display. Do not include personal information in your display name.

5. In-App Purchases

Don't Touch Red offers optional one-time in-app purchases (cosmetic themes). All purchases are:

• Processed through the Google Play Store and subject to Google Play's Terms of Service
• One-time, non-recurring purchases (not subscriptions)
• Final and non-refundable, except as required by applicable law or Google Play's refund policy (Google Play provides an automatic refund window — see their policy for details)
• Non-transferable and tied to the Google account used for purchase

Prices may vary by region due to currency conversion and local tax requirements.

EU/EEA and UK consumers: You have a statutory right to withdraw from digital purchases within 14 days. However, by proceeding with an in-app purchase for digital content (such as a cosmetic theme) that is made immediately available, you expressly request immediate performance and acknowledge that your right of withdrawal is lost upon delivery, pursuant to Article 16(m) of EU Directive 2011/83/EU and equivalent UK legislation. This does not affect any statutory rights you have under applicable consumer protection law.

6. Restoring Purchases

If you reinstall the app or switch devices while using the same Google account, your previously purchased themes can be restored. Use the "Restore Purchases" option in the in-game settings if your content does not automatically appear. Purchases are tied to your Google Play account and cannot be transferred to a different account.

7. Virtual Currency

In-game coins are virtual currency with no real-world monetary value. Coins cannot be transferred, sold, traded, or exchanged for real currency or any other item of value outside the game. We reserve the right to modify, adjust, or discontinue virtual currency balances or features at any time, with or without notice, to the extent permitted by applicable law. Coin balances are forfeited upon account suspension or termination for violations of these Terms. In the event we discontinue the game, coin balances will be lost without compensation, to the maximum extent permitted by applicable law.

8. Advertisements

Don't Touch Red displays advertisements via Google AdMob. Ad display is subject to your consent preferences as described in our Privacy Policy.

9. Google Play Games Services

Don't Touch Red integrates Google Play Games Services (GPGS) for achievements and leaderboard features. Use of GPGS features is subject to Google Play's Terms of Service and Google's Privacy Policy. GPGS features are optional and the core game is fully playable without signing in to GPGS.

10. Account Deletion

You may request deletion of your game account and all associated data — including your coin balance, unlocked themes, and leaderboard entries — at any time by contacting us at privacy@donttouchred.com. We will process deletion requests within 30 days. Leaderboard entries will be removed or anonymized within 30 days of a verified deletion request. Purchased themes are tied to your Google Play account and are non-refundable upon account deletion.

11. Intellectual Property

All content in Don't Touch Red — including but not limited to game design, graphics, sounds, music, and code — is owned by or licensed to us and protected by applicable intellectual property law. Nothing in these Terms transfers any ownership of intellectual property to you.

12. Disclaimer of Warranties

Don't Touch Red is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the game will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the app is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use Don't Touch Red, including but not limited to loss of in-game progress, virtual currency, or data. Our total liability to you for any claim arising from these Terms or your use of the app shall not exceed the amount you paid us in the twelve months preceding the claim, if any.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above may not apply to you in full.

14. Dispute Resolution

We encourage you to contact us first at support@donttouchred.com to resolve any dispute informally. We will attempt to resolve the matter within 30 days of receiving your written complaint.

If you are located in India and the dispute cannot be resolved informally, you may refer the matter to the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, or to the Central Consumer Protection Authority. For disputes not subject to consumer forum jurisdiction, the courts of [YOUR CITY], India shall have exclusive jurisdiction.

If you are a consumer in the European Economic Area or the United Kingdom, you may bring proceedings in the courts of your country of residence, regardless of the jurisdiction clause above.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of laws principles. If you are a consumer resident in the European Economic Area, the United Kingdom, or Australia, the mandatory consumer protection laws of your country of residence apply to the extent they cannot be excluded by contract, and nothing in these Terms limits those rights. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will update the "Last updated" date above when changes are made. Continued use of the app after changes constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify users.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding Don't Touch Red and supersede any prior agreements or representations.
